MNLU in association with IBBI organises Certificate Programme on Insolvency and Bankruptcy Laws



ABOUT MAHARASHTRA NATIONAL LAW UNIVERSITY MUMBAI

MNLU Mumbai is one of the premier national law universities located in the economic capital of India. It offers graduate, postgraduate, research degrees in law and allied disciplines. The object of the university is to advance and disseminate learning and knowledge of the law and legal processes and their role in national development, to serve society in the field of law by developing skills regarding advocacy, legal services, legislation, law reforms, to organize lectures, seminars, symposia and conferences to promote efficient instruments of social development. MNLU Mumbai has set up a Centre for Insolvency and Financial Laws amongst the fourteen centres for legal research. The Centre aims to act as a think-tank in furtherance of the principal objective of raising awareness about financial laws in theory and practice, as well as conducting high-quality research in the field to assist policymakers by educating the next generation of lawyers and law students through seminars, conferences, workshops, and symposiums.


ABOUT INSOLVENCY AND BANKRUPTCY BOARD OF INDIA

The Insolvency and Bankruptcy Board of India was established on 1st October 2016 under the Insolvency and Bankruptcy Code, 2016 (Code). It is a key pillar of the ecosystem responsible for the implementation of the Code that consolidates and amends the laws relating to reorganization and insolvency resolution of corporate persons, partnership firms, and individuals in a time-bound manner for maximization of the value of assets of such persons, to promote entrepreneurship, availability of credit and balance the interests of all the stakeholders. It is a unique regulator: regulates a profession as well as processes. It has regulatory oversight over the Insolvency Professionals, Insolvency Professional Agencies, Insolvency Professional Entities, and Information Utilities. It writes and enforces rules for processes, namely, corporate insolvency resolution, corporate liquidation, individual insolvency resolution, and individual bankruptcy under the Code. It has recently been tasked to promote the development of, and regulate, the working and practices of, insolvency professionals, insolvency professional agencies and information utilities, and other institutions, in furtherance of the purposes of the Code. It has also been designated as the ‘Authority’ under the Companies (Registered Valuers and Valuation Rules), 2017 for regulation and development of the profession of valuers in the country.


ABOUT THE CERTIFICATE PROGRAMME

MNLU Mumbai has designed a One-week Certificate Program on Insolvency and Bankruptcy Laws with the vision to become one of the leading platforms for insolvency and financial laws research and providing an international and comparative perspective about insolvency and financial laws, that will foster an increased focus on a multi-disciplinary approach to identifying insolvency and financial law issues and facilitate systemic changes in the field. The purpose of this course is to broaden our horizons on insolvency and bankruptcy law with detailed concepts and includes the challenges faced, litigations piled up, comparative analysis, recent changes, case lawS, etc. Learning from Eminent academicians and industry experts will make the study fruitful and constructive. It will introduce participants to many aspects of insolvency law and also prepare them for further advanced studies and research in Insolvency and Bankruptcy laws.

  • The goal is to broaden the scope of understanding the current Insolvency laws and to encourage teachers and experts to investigate and interact with alternative paradigms in this field.
